I acknowledge that ACS will retain this form and a record of any disclosure, and may verify this request with my agency before release.
Privacy & Legal Notice
Processing: ACS Security Group Inc. may require up to 7–10 business days to review and release requested information. All requests must be submitted from an official agency email address. Absent a court order, disclosure is voluntary and at ACS's sole discretion; nothing in this form obliges ACS to preserve or disclose any record.
Privacy: Personal information is collected, used and disclosed in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA), S.C. 2000, c. 5. Disclosures to law enforcement are made only: (a) under a subpoena, warrant, production order or court order (s. 7(3)(c)); (b) to a government institution that has identified its lawful authority and stated a law-enforcement purpose (s. 7(3)(c.1)); (c) on ACS's initiative respecting a contravention of law (s. 7(3)(d)); or (d) in an emergency threatening life, health or security (s. 7(3)(e)), in which case PIPEDA may require written notice to the affected individual. Where an officer requests voluntary preservation or disclosure without a court order (as contemplated by Criminal Code s. 487.0195), ACS discloses only where permitted by PIPEDA and where, in ACS's assessment, no reasonable expectation of privacy requires judicial authorization (R. v. Spencer, 2014 SCC 43). ACS releases only records responsive to the date, time and camera scope specified and reasonably necessary for the stated purpose, and logs every disclosure. ACS is licensed under the Private Security and Investigative Services Act, 2005, S.O. 2005, c. 34 (Ontario).
Ownership & liability: CCTV systems and footage may be owned or controlled by ACS's client at the serviced site; ACS may be contractually required to obtain the site owner's authorization or to redirect the request to the correct record holder. Footage is provided as-is; ACS makes no representation as to completeness, continuity or timestamp accuracy, and accepts no liability arising from the requesting agency's use, storage or onward disclosure of released material. ACS may verify the identity and authority of the requesting officer via the agency's publicly listed telephone number before any release. CCTV footage is retained for a limited period — submit preservation requests as early as possible to prevent routine overwriting.
